What Services Are Included in Tree Care Maintenance Plans?
The following services will be provided at each service visit (1x/year for annual plans, 2x/year for semi-annual plans, 4x/year for quarterly plans, 12x/year for monthly plans)

b. Inspect tree well for proper water retention
c. Discuss proper watering schedule for seasonality and make adjustment recommendations if needed

g. Inspect trunk caliper/strength and make staking adjustments
h. Tree canopy inspection
2. Tree Trimming & Pruning (3x/year for monthly plans, 2x/year for quarterly and semi-annual plans)
3. Soil Injection (4x/year for monthly plans)
a. Deep root fertilize using Moon Valley Nurseries’ proprietary blend to boost growth and enable fast recovery from seasonal stress
4. Rejuvenation
a. Replenish tree wells with premium mulch

• The Tree Care Maintenance Plan program is subject to Moon Valley Nurseries’ Retail Terms and Conditions of Sale as stated on the purchase invoice and available for review at https://www.moonvalleynurseries.com/toc-of-sale.
• Tree Care Maintenance Plans are sold based on scope of work observed during initial consultation. If Customer plants additional trees during the term of Customer’s Tree Care Maintenance Plan service agreement, the price of Customer’s Tree Care Maintenance Plan may be adjusted or newly-planted trees may be excluded from service at Moon Valley Nurseries’ sole option.
• All Tree Care Maintenance Plan purchases are final sale and no prorated refunds will be given for cancelled service visits.
• While our Tree Care Professionals will provide informed advice regarding recommended volume and frequency of tree watering depending on the season, we do not program or maintain customer watering/irrigation systems. It is the customer’s responsibility to adjust and maintain the customer’s tree irrigation system.
• Service visits will be scheduled to occur within a calendar year of date of purchase subject to reasonable delay due to equipment and crew availability and weather conditions.
• While Moon Valley Nurseries expects purchase of a Tree Care Maintenance Plan will extend the health and life of Customer’s trees, the Tree Care Maintenance Plan is not a warranty. Moon Valley Nurseries does not guarantee the health or life of trees being cared for under a Tree Care Maintenance Plan. Replacement trees, if desired, are available for separate purchase.
• Storm damage may be excluded if it requires additional tree trimming beyond scheduled Tree Care Maintenance Plan services. Additional tree trimming (such as limb removal, hazard reduction, and clearance for pedestrian and vehicle access) and tree removal (if required) related to storm damage or other casualty event, e.g., fire, are available for separate purchase.
• Tree and stump removals are excluded from Tree Care Maintenance Plan service, but are available for separate purchase.
• Customer agrees to make property reasonable available for service on date of scheduled Tree Care visit. Gates must be unlocked (or gate code provided), pets must be restrained, and trees must be reasonable accessible for service (not blocked by debris, stored items, etc.).
• Customer agrees and acknowledges that Customer is solely responsible for ensuring that all necessary utilities are readily available for performance of the Tree Care Maintenance services ordered by Customer from Moon Valley Nurseries, including but not limited to electrical, water, and any other services needed.
• Moon Valley Nurseries will exercise due care in the performance of its work and in meeting scheduled service visits, but will not be and is not responsible for delays in performance of services as service dates, times, and windows are estimates only and guarantees.
• Customer agrees and acknowledges that after pruning, sap may ooze from areas where cuts were made. Moon Valley Nurseries is not responsible for sap stains that may occur from hauling debris from the work zone to the truck or from any area where tree care service has been performed.
• Customer further acknowledges and agrees that Customer is solely responsible for, and will hold Moon Valley Nurseries harmless for any damage, loss, or issue, arising from or relating to: any property line dispute with neighboring properties, obtaining or furnishing any required or applicable permit and compliance with any applicable codes, ordinances, regulations, or requirements, including but not limited to any homeowner association rules.
• Dispute resolution: Customer has the right to file a written complaint with the Arizona Registrar of Contractors for an alleged violation of A.R.S §32-1154(A), which must be done within the applicable time period set forth in A.R.S §32-1162(A). The phone number for the Registrar of Contractors is (602) 542-1525, and their website is www.roc.az.gov. In the event of a dispute between the parties over this agreement, including the execution thereof, the parties hereby waive their respective rights to litigate such issues in court, and instead agree to resolve any dispute through private, binding arbitration in the state and county where this agreement was executed. The parties agree to enter arbitration through the American Arbitration Association (“AAA”) and abide by its Commercial Arbitration Rules. Any such proceedings shall be completed within 120 days from when an arbitrator is appointed, as may be extended by the arbitrator or the parties’ mutual express agreement. The arbitration shall be conducted by one arbitrator, who shall be mutually selected by the parties, or, if the parties cannot agree, shall be selected by the AAA. The laws of the state where the purchase was made will apply to the arbitration proceedings, without regard to conflict of law principles. The parties agree to abide by any award issued by the arbitrator, and the judgment (if any) may be entered into any court of competent jurisdiction. The costs of the arbitration shall be equally split by the parties unless otherwise ordered by the arbitrator, who may award any fees or costs, including reasonable attorneys’ fees, to the prevailing party, subject to the laws of the applicable jurisdiction.
• It is agreed and understood that this agreement is the full agreement between the parties, and that no other terms, conditions, statements, warranties, representations, or understandings, written or verbal, expressed or implied, are part of this agreement, that if any part of this agreement is declared illegal, void, or unenforceable, the remaining terms shall stand and remain in full force and effect, and by digitally signing, checking any box or field indicating agreement or acknowledgment, or otherwise signing these terms in any way, shape, or form, including any and all digital and electronic formats, Customer agrees to these terms and conditions.
