The Year 2 Assurance Plan protects each covered tree against loss for one (1) year from the date of Year 2 Assurance Plan purchase. This includes frost, wind (so long as the tree continues to be double-staked), heat stress, weather-related damage, pest damage, and normal loss of a tree.Moon Valley Nurseries will provide one replacement tree for each Year 2 Assurance Planpurchased.

Moon Valley Nursery may, at its discretion, assign an arborist or tree care specialist to assess the tree, who will make a final determination, in Moon Valley Nursery’s reasonable sole discretion,if the tree needs to be replaced or can be treated. If a treatment plan is initiated, Moon Valley Nursery may, at its discretion, extend the duration of the Year 2 Assurance Plan to allow for completion of the treatment. In this case, if the tree does not recover following the treatment plan, it may be eligible for replacement beyond the standard one-year protection period.

Replacement tree will be of the same size and specimen as purchased on the original invoice. For instance, if a customer originally purchased a “Huge” size tree, when the warranty is used, the replacement tree will be the “Huge” size as well. The Year 2 Assurance Plan does not include the cost of equipment (such as a crane) or Get to the Job variable delivery fee for delivery distances greater than 50 miles. Variable delivery and equipment fees, if applicable, are the customer’s responsibility and not included in the Year 2 Assurance Plan. Please ask your Landscape Designer if this will apply to your purchase.

If a customer purchases multiple trees that are the same size and type, he/she must purchase a Year 2 Assurance Plan for each tree in that group. For example, if the customer is purchasing 5 Huge Ash trees, and customer wants to purchase a Year 2 Assurance Plan, the customer must buy 5 Year 2 Assurance Plans to correspond to all 5 Huge Ash trees in the group. No Exceptions.

If a Year 2 Assurance Plan is purchased and the tree dies, Moon Valley Nursery will have up to, but no longer than, 90 days to provide the replacement.

If the Year 2 Assurance Plan is exercised during the covered period and a replacement tree is planted, the replacement tree will have a 90-day transplantation shock warranty. Year 2 Assurance Plan must be redeemed at the store where the original purchase was made.

There will be no prorated refunds on any Year 2 Assurance Plans bought by the customer.

Customers are eligible to purchase a Year 2 Assurance Plan after their first year of Protection Plus expires, as an alternative to renewing Protection Plus for a second year. If the customer declines to renew Protection Plus for a second year, and instead purchases a Year 2 Assurance Plan, customer will receive the warranty coverage only and not the Tree Care Services component included in Protection Plus. The Year 2 Assurance Plan is not otherwise available for purchase.

The Year 2 Assurance Plan will be void if the customer attempts to remove and replant the product in a different location, or if the product is not properly watered in accordance with Moon Valley Nursery’s care guidelines, including but not limited to overwatering, underwatering, or other improper irrigation practices.

Unless otherwise stated above, this Year 2 Assurance Plan includes all of the terms and conditions as stated on the back of the original purchase invoice.
